Open / Start a School in India and CBSE Affiliation

Schools in India has to function as a “NOT FOR PROFIT” in the form of Society / Trust or a Section 8 company. I have written a separate post on the formation of the Trust & Society. Any school which is affiliated to the state board and has the ‘No Objection Certificate from the State can apply for CBSE Affiliation. Let us go through this post and understand how can you start a CBSE School in India. The minimum land requirement by CBSE is 1.5 Acres but there is a host of factors which can play a part in this requirement such as Type of City, Population, Location of the land, Type of Property etc

LAND REQUIREMENT FOR A CBSE SCHOOL IN INDIA

Location is Urban or Rural, the area will be determined by the above. For more information, you can read this post here. Click Here 

The number of sections a school can run is also tied to the land parcel shool shows, though later on an application for section increase can also be made if school gets to occupy more land. The formula for section per acre is as follows;

Total Land to Sections Ratio: 12 sections for every 2000 square meter additional land.

Cost of building a School

A school normally requires construction in phases (Here I am talking about a Budget CBSE School meant for a 1000 students)

  • Phase 1: 20,000  sq ft to 25,000  sq ft construction – Year 1
  • Phase 2: 12,000  sqft- 15,000 sq ft – year 3
  • Phase 3: 6,000  sqft – 10,000 sq ft – Year 4

You multiply these numbers with Rs 1000 – 1,400 per sq feet and this will give you a ballpark costing of construction plus furniture. Over and above this you can spend on Marketing, Landscaping, Sports Facilities etc. That is completely dependent on the promoter’s vision.

I get queries with regards to what all do we have to build, here is the list though this is only suggestive but I believe a good school should certainly have these;

Classrooms*: Classroom dimension for CBSE School: The size is 500 sq feet for 40 students. For class rooms of size less than 500 sq feet the enrolment (maximum number of students) shall be 0.08 X size of class rooms in sq feet.

Regular Toilets for students and staff*, Toilets for Children with Special Needs* – Boys & Girls Staff Area, Staff Room, Counsellors Room, Head of Department Cabins, Infirmary, Couple of Big Store Rooms, Hatch for LIFT hatch or the Ramp on stairs, Music / Dance / Art / Craft studio, Cafeteria, Auditorium, Library* (minimum 1,160 sq feet), Computer Lab*, Maths Lab*, Biology Lab, Physics Lab, Chemistry Lab, Composite Science Lab*, Robotics Lab, Administration Area (Reception, Accounts, Managers, Admission Counsellor, Conveyance Manager, Public Relations Office etc, Directors Office), Principal Office, Vice Principal Office, Exam Department, Server, CCTV Room, Security Guard room, Sports Room, Parking, Staff Quarters

The one marked with * are mandatory.

State Board Affiliation

A School has to have the affiliation from the State Board. It doesn’t matter if it is eventually affiliated to CBSE / ICSE or IB Board. Education is a state subject, hence the can have any affiliation but State BoardAffiliation / Permission is MANDATORY.

Franchise

Starting any Brand Franchise: There are a lot of franchise (Brands) to choose from like Brighton International School, DPS, Bhartiya Vidya Bhavan, Everonn, Manipal, Shamrock, Mayo College, Kangaroo Kids etc.

All these have a proper corporate office where there are teams involved with the expansion of the chain. Their website is the way one can get in touch with them. Typically they charge a Security Deposit (to be fixed for a stipulated period) a Licence Fee (chargeable every year) and a Revenue share per student. None of this is fixed and may depend from organization to organization. They will help you in setting an elementary process and curriculum right.

Starting the School (Essential Steps)

Form a Trust/Society/ Section 8 Company

As per the government’s norms, the administrative power of the school should be vested in a Not-for-profit society or trust. Every state has an office of Registrar where a society can be registered. This is the address of the few of the offices across different states; for more, you can read here

Register/ Lease the Plot of Land

The Land on which the school will be built has to be either leased out or should be in the name of the society or the trust. The documents should be certified by the local land registration office. For a CBSE school inside the city limits the minimum area should be One Acre and outside the city limits should be 1.5 Acres. Kindly remember the Land should all be at One Place and in One Piece with Pucca Boundary Wall (minimum 6 feet high) on all the sides.

I get the maximum amount of queries regarding the size of the land, especially from Metros. CBSE has amended the bye-laws regarding the requirement of land. Kindly go through the circular. It specifically states the land required for starting a school in Metrosshould be greater than 1600 Sq Meter (about 0.4 acres) for Pre Primary to Class X, and about an acre for Classes up to Class XII. For the rest of India, the rule has stayed the same as described above. I have written a separate post on this topic, here is the link. If the land is leased out to the ‘Not For Profit’ entity the minimum LEASE DURATION should be 15 Years. In case of ownership, the land title documents is a Sale Deed/Conveyance Deed/Gift Deed/Lease Deed/Sub lease/Allotment Letter etc. duly registered before the Registration Authority concerned of the State as per rules.

GET THE STATE BOARD AFFILIATION(Get an approval from the local Education Office ) – Once the building and the staff is ready, open admissions. Simultaneously go to the local education office in most cases DEO (District Education Office) and register by paying the fee. Post inspection of the school premises and after taking the relevant information they will provide the society/trust with required certification. The school will first take-off after the permission from the state board. This is essential, there has been a ruling by the court on this aspect. The above mentioned steps simplistically captures, how you start school in India, now moving to ‘How to get CBSE Affiliation for your school’?

HOW TO GET CBSE AFFILIATION

For a NEW School applying to CBSE for the first time, there are five options to choose while applying for affiliation;

  1. Approval for Middle School Syllabus
  2. Fresh Affiliation Up to Secondary Level
  3. Fresh Affiliation up to Senior Secondary Level
  4. Switch Over Category (school which has been churning out Class X or XII with the state board and now wish to get converted to CBSE)
    • Secondary Level Switch-over from other boards
    • Senior Secondary Level Switch-over from other boards

Which one should you choose – This depends on the

  • How ready is your infrastructure – Senior Secondary Level requires Labs and it will require classrooms for all the classes from Class I to Class XII
  • How ready is the market in terms of demand – It is very unlikely in a competitive market that a school opens and students will shift in large numbers in higher classes. So choose wisely.
  • How much can you spend on the staff  – To employ PGT i.e senior teachers one has to pay good money, as partly explained in point 2, to get affiliation you have to show the entire Staff as well up-till Class XII, hence most of the schools grow slowly.

The best option: The best option is to choose the Option number 2, Fresh Affiliation Up to Secondary Level. This will secure school affiliation till Class X and later after a year, school can re-apply for Senior Secondary Affiliation.

This entire process of affiliation is a very transparent process and in case one is ready to do the paperwork, you really don’t require any touts or middleman. With effect from 07.01.2021, the dates for application are as follows;

From 18th March 2021, CBSE transformed its Affiliation process and renamed the process as SARAS (School Affiliation Re-Engineered Automation System). SARAS looks to do the following;

  • Timeline for affiliation reduced to 4 months time
  • Automatic Approvals based on Data Analytics for Extension/ Upgradation/ Section increase etc
  • Use of Machine Learning / AI to read documents
  • Relies on self certification and public disclosures
  • Provision of Virtual inspection
  •  Instant flow of information to applicants

CBSE provides the school with a list of bye-laws to be kept in mind while applying for CBSE Affiliation. The entire manual can be downloaded from the CBSE’s official website. Here is the website – CBSE e-Affiliation Website and choose SARAS, link to download the  Bye-Laws – Affiliation Bye-Laws

Step 1 – The School before getting into the online form filling, should be ready with the following;

  1. Digital Signatures – to authorise your final submission. The Chairman/ Member/ Trustee/ Director or any representative can use its digital signatures. How to get Digital Signature, click here.

6 documents 

  1. No Objection Certificate – Its a certificate issued by the State Education Department (Secretariat) to the effect that State Government has no objection to the affiliation of the School with CBSE . For a brief period of time this certificate was revoked by the CBSE but in December 2016, it has again made the entry. I have detailed it in a separate post here. Click Here.
    1. The School basically have to write an application to the State Education Secretary Office (located in the state’s capital) and ask for NOC so that the state allows a school to follow CBSE. This can be a simple application where a copy of the application goes to local DEO office.
    2. If NOC/Recognition certificate is in vernacular language, then the school must upload its duly notarized translated copy in English/Hindi along with the signed copy of NOC/Recognition certificate in vernacular language. Kindly note, there is specific department in the state government responsible for transaction.  
  2. School Recognition Certificate from concerned State Education Department as per extant rules and provisions contained in RTE Act 2009. This is also called Affiliation Certificate by the State Board.
  3. Land Certificate as per the Appendix X of the Affiliation Bye-laws : The Competent Authority t o issue the land certificate is DM/ ADM/ SDM / Tehsildar/Naib Tehsildar/ Registrar/ Sub Registrar or any other equivalent authority competent to issue such certificate. Download the format here. 
  4. Fire Safety Certificate to be issued by the Fire Safety Department of the State Govt./ Competent Govt. Authority such as Municipal Corporation etc. as per prescribed norms with validity (validity as on date of final submission of application).
  5. Building Safety Certificate To be issued by competent government authority or the empanelled engineers authorised to issue such certificates by the appropriate Government. For e.g. Empanelled engineer by Municipal Corporations /Development Authorities (PWD)/ Roads/ Building Department etc.
  6. Certificate of Registration of Society/ Trust/ Section 8 Company running the school.
  7. Get your School Website Ready with the information as per the CBSE requirement. Check the requirements here. The website should have the curriculum details, TC Sample, Norms for fixing Fee, Affiliation Status, Students details, Address, List of books prescribed along with undertaking by the Principal, Annual Report, School Circulars, Fee Details, Details of Teachers Training, Academic Achievements, Self Affidavit of the School (This usually is getting made on 100 Rs Stamp Paper. Here is a sample for your perusal.).
  8. Information about UDISE Code
  9. Scanned copies of Audited Balance Sheet
  10. Video Clips & Geo Tagged Photos
  11. Transport Safety Certificate
  12. Soft copy / Scanned copy of Academic Calendar.

Step No. 2: Start filling the Online form 

  1. KYC Form 
  2. Initial Part Payment of Rs 10,000
  3. Part A – input the information of the 6 forms listed above
  4. After submitting all the information as per Part A of the application, school will have an option to generate System generated Self-certification or System generated DEO certificate on the basis of data filled in Part A. In case the school opts for Self-certification, the school is required to upload the same with digital signature of the school. However, in case school opts for DEO certificate, the school is required to get the DEO certificate duly signed by DEO/DIOS/Any other officer authorized by State/UT Education Department and upload the signed copy of DEO certificate with digital signature of the school. The registration of the school once completed after filling part A shall be valid till last date of submission of application for the respective session.(i.e. for the session 2022-23, registration of the school shall be valid till 31st October, 2021). If the school fails to submit part B by the last date of submission of application for the respective session, then the registration shall automatically be termed as invalid and the registration fee, if any, shall be forfeited.
  5. Part B – Upload the 6 documents and input all the other basic details and other information
  6. Make the Part and the Final payment

Step 3 – Within 15 Days of Submission of Online Application Inspection Committee will be formed

The Physical Inspection of the school has to happen Within 22 days of the constitution of Inspection Committee.

Along with the inspection committee letter, the Board shall give three dates of inspection. Inspection can be conducted on any of these three dates as mutually decided by the Inspection Committee and the School.Without wasting any time, get in touch with them and arrange for them to come. Mostly one of them would be a Central School (Kendriya Vidyalay) Principal and the other one an experienced hand from any aided or un-aided school.

In case, the inspection committee is ready and the school intentionally fails ls to get the Inspection done on the stipulated dates and timespan (except for the reasons beyond control), the school will be penalized with a monetary penalty of Rs 25000 and fresh schedule shall be communicated . The school shall get another opportunity, however the application shall be rejected if the school fails to get the inspection done after three opportunities.

STEP 4 – Prepare a file

The School has to arrange for a Videographer on the date of inspection. Here is a guideline issued by the CBSE for Videography;

For Boundary , Main Gate , Parking and other Open Area The person with videography skills should ensure wide angle coverage of video.

For Laboratory/ies The videographer should ensure wide angle coverage of video while entering the lab. Thereafter the person with videography skills should cover all equipments and other facilities in the lab. During this the concerned subject teacher should also be available in the lab to response to the queries of IC members and show the stock register.

For Library The videographer should ensure wide angle coverage of video while entering the library. Thereafter the videographer should cover all bookshelves, magazines & periodicals, reading area, and other facilities such as computers with internet connectivity in the library. During this the librarian should also be available in the library to respond to the queries of IC members and show the catalogue, accession and issue register.

For Toilets Wide angle coverage of video including WCs and Basins.

Class Rooms : Occupied and Vacant The videographer should ensure wide angle coverage of video while entering the rooms. Thereafter, the videographer should cover all fixtures, furniture and other facilities in the rooms.

Other Rooms such as Staff Room, Music Room etc. The videographer should ensure wide angle coverage of video while entering the rooms. Thereafter the videographer should cover all fixtures, furniture and other facilities in the rooms.

Videography details during CBSE inspection

Grant of Affiliation

Once the inspection is done and the inspection report is submitted during the inspection, the Board will grant the affiliation within 30 days of submission of Inspection report. If there are any deficiency pointed out, the school has to replay within 15 days of the letter.

I keep getting a lot of queries on this particular post. Here are some answers I am posting for everyone’s benefit; I also have a consultancy arm which helps entrepreneurs and schools start up to establish and run schools of high quality.

1Do I have to procure affiliation and then start the school?NO You can only apply for affiliation once you have started the institute. The affiliation asks for a lot of information regarding the students’ strength teachers etc which can only be filled once you start the school.
2My society comprises of members of my family, what do I do to make it of “Non Proprietary” nature?Off all the members in a society majority i.e more than 50% cannot be related by blood. Also while declaring the members of the society in the affidavit the Chairman will have to declare the relationship among the members who all are related by blood line.
3I am running a school in a rented building. Can I apply for affiliation?The law clearly states that the school should have Proof regarding possession of 2 acres of land (pg 60 of bye laws). Hence the school can run in a rented building but the land on which the building is built should be owned or leased to the society. Society can lease the land to a company which can then construct the building and can charge the society a rent on its investments.
4Do I have to take State Board Affiliation to start a School, Can I directly apply to CBSEYes you have to procure State Board Affiliation post that only you can go for CBSE Affiliation.
5Is this the entire list of documents?I believe this is the list in case they need more information you can always ask for more time.
6Salary drawn by Teachers at my institute is not at par with State Norms or Central Government NormsDon’t worry about it. Salary is a subjective topic and can vary from city to city within the same state. It all depends upon the cost of living in that particular area. Don’t worry about low salaries. You just have to be fair in showing that what you have specified in the offer letter is what is going in the bank account and the same is getting signed by the employee.
7Land original documents are with the Bank as collateralGet a photocopy attested by the bank that this is a true copy of the documents pledged with them. Get the bank manager sign on the photocopy.
8Approximately what is the time between submission and inspection and how much time is spent by the inspection Team on the campusIt takes about 3-4 months from submission to inspection and the team spends about 5 to 6 hours (Arrange for them to have meals either in the school or a place nearby).
9What is the investment required to open a schoolThis query invites a subjective response but a thumb rule for starters / planners. 2 Acres of land at the market price plus cost of construction at about 1200 Rs per square feet.
10Non-Proprietary Affidavit. What do I do when some members are related to each other?This is a very general trend across societies though advisable is very few members should be related to each other (blood relatives). Even if people are related to each other the Chairman/Head of the trust society should declare the same while submitting the Non-Proprietary affidavit that ‘x’ person is related to ‘y’ person through by ‘z’ relationship.

    We have applied for CBSE Affiliation upto secondary level, session 2016-17,
    For that we have some queries sir,
    1) That the school had intimated to the concerned “Education Department of the State”.
    a) We have intimated the concerned Edu Dept of State Govt. through a letter on 3/6/2015 that we have applied for CBSE Affiliation. But we have not yet received any reply, does it reflect as a DEFICIENCY during INSPECTION.
    2) We are following XSEED curriculum mapped to NCERT from class 1 to 7, NCERT curricullum for class 8. (we are running class 1 to 8 for the session 2015-16) does it reflect as a DEFICIENCY during INSPECTION.
    Please suggest us in this regard.

    My school has got the affiliation status today as granted.I have got 10 students waiting in class 9th .The grant letter is not yet uploaded.Thus the pass word and the school registration is not possible without the grant letter.Should I wait for the grant letter or I should shift these students to some other school as the admissions for class 9th are possible only before 30th August.

      Congratulation on getting affiliation. Take those admissions, and inform the regional office about the same. If need be go to regional office and put up your case, they are the one who are responsible for the Class IX admissions data handling duties.

      :-Land and building belongs to me(Father), do I need to change it on trust name? – Ask him to lease it to the trust for a minimum period given in by laws.
      :-Till Vth standard do I need to have my school registered in district education department. Or I can start the school? – Doesn’t matter the classes upto which a school is running, you have to get an affiliation from the state board.
      :-Affiliation from any board required? yes when?(Planning for CBSE only) – State Board definitely. It is a compulsory requirement.
      :-Any specific norms for primary school ? – Go through the bye laws of the state board and CBSE.
      :-State board affiliation process. – Check with the local District Education Officer’s office.

      You have to specify which board’s approval you are looking to acquire. If CBSE please go through the CBSE Bye Laws, visit http://www.cbseaff.nic.in and if you just want to start a school upto standard II, than you can just adhere to the local state board conditions and can start, for that get in touch with the local DEO office and enquire about the state laws for affiliation. You can also get an idea from the education department’s website here http://www.educationbihar.gov.in/ACTPrimary.aspx

    1. Surely one can secure admission into any board from any board in any given class. its only admission into class X and Class XII is when one needs some additional documents.

      The difference is in the books they follow, the course they cover class wise. I am not stating the standard of the schools as that is a subjective opinion.

      Before construction of the school, get the building layout approved also make sure the building has adequate facilities built in for a school like staff room, accounts section, library, computer lab, toilets etc.

    1. Getting a TC should not entail any fee. For a school’s complaint you can always get in touch with the local District Education Office. TC for class IX and XI classes need to get countersigned from the CBSE office they can take about 20-25 days.

    I run a school affiliated with PSEB Mohali (Punjab). Classroom size is according to the pseb board (ie 15’* 20′ ). Can I get affiliation of CBSE Board. We fulfill other condition properly.     This year we have applied for CBSE affiliation for secondary level. And prior to that, we already have affiliation from local DEO till class 8th. My question is once we get the affiliation from CBSE most probably next year, do we still answerable to DEO authorities for example in terms of RTE, Result reigster etc.

    The status of our application shows Deficiency after IC, 15/07/2015. This is the 2nd time we are receiving the deficiency letter. The letter says ‘Coming Soon’. I have the following concerns:

    1) Will the school be able to obtain the affiliation for session 2015-16 if all the deficiencies be removed.

    2) Is there ample amount of time for the CBSE, to grant affiliation for 2015-16. I mean is there a time cut-off for granting affiliation for a particular academic session.

      1. Doesn’t matter what level of affiliation you seek you will have to take affiliation from the state government.

      Roads do not matter for CBSE affiliation. Though if the campus is not approachable or have roads which are very narrow, the school will face difficulty in getting admissions and manage their conveyance (Bus) facility.

      It is possible to get affiliation up till Class X and that is the affiliation up to secondary level you should aim for. The dates are done for this year, I suggest try for next year.

    We are applying for affiliation with CBSE by switching from State Board of Maharashtra, as we know now NOC is not required from State Board but intimation to the concerned Education Dept. of the state about application made to CBSE for affiliation is required.     1. Hi there,
      School should not be taking admission into Class IX in case they don not have an affiliation from the board. The school should have secured admission when Class VIII was coming up in case if it is a new school. As the process of affiliation gets over by jan/Feb of next year and registration for Class IX students gets over by October. Please have a word with the school authorities, doesn’t look healthy to me.

      1. Yes you can go for CBSE affiliation, if all the land documents are in place along with the other requirements.
      2. The clause of land leased to the society is an alternative to ‘in case’ the land is already not owned by the society or trust. In your case if the land is in the name if the trust, please move along for CBSE affiliation procedure.

    In the format specified, we need to fill the Sales Deed and then Lease Deed details and get it signed with concern authority. Question here is if we have more than 1 sales and lease deed for the land of school, then how should we accommodate that scenario.

    I applaud your research and keen insight about the school business in India. I am an edupreneur and wish to open a school from Nursery to 5th standard in the NCR. I have read your blog post and have a quick question –

    1. Even for a school for pre-primary & primary, does the DOE have strict requirements for land area, building specs, teacher ratio, playground size, etc, etc, etc? Is it that difficult to get a state board affiliation? Is it mandatory for a school till 5th standard?

    2. Once I get the state board affiliation, would I have to teach the state board syllabus, or can I teach CBSE syllabus? Is there a separate approval I need for teaching CBSE syllabus? Because there are many schools around me till 8th that are not affiliated with CBSE, but teach the same syllabus and advertize the same.

      Answer to your queries
      – State affiliation norms are not that stringent, and they are mostly similar across India. Getting state board affiliation is not difficult.

      – Generally speaking Affiliation and Syllabus becomes a matter of discussion only for Class IX an upwards. Before that it is all a Home Examination scenario. A school is free to decide the syllabus and the course.

        1. Yes there is a criteria, please go through the bye laws. In 3500 sq Feet, you can’t run a CBSE School. To start any school you have to procure the permission from the state government.

    While filling CBSE Affiliation form, I got to know that school needs to have following certificates from competent authorities.
    1. Health and sanitary conditions,
    2. Drinking water,
    3. Fire safety

    – What I am unable to think is from where we have to get these things done?
    – Do we have a specific format for them?
    – Also the online application says if you have such certificates then attach copy of same. But there is no place for attachment in the attachment section on the online form for these certificates.

      You have to go to Municipal Authorities and Public health Department to get these certificates. Therein no specific format. Just get a letter which mentions they have inspected the campus and the amenities and safety arrangements have been found to be satisfactory.

      They are not required when you apply online.

    1. The school has not submitted translated copy of land documents i.e. lease deed and sale deed Sale/Lease Deed in favour of School/Society running the school duly executed in the office of the Sub Registrar.
    2. The school is required to submit certificate from Bank certifying that the salary to the staff is being paid through ECS.
    3. The school is required to submit documentary proof to the effect that the school is paying salary and allowances to its staff at par with the Central/State Govt. employees along with the notified salary and allowances details of the State/Central Govt.

    4. The school has not hired the trained and qualified staff, since, school is currently having 12 untrained NTTs and 08 untrained PRTs and TGTs.

    1. 3. The school is required to submit documentary proof to the effect that the school is paying salary and allowances to its staff at par with the Central/State Govt. employees along with the notified salary and allowances details of the State/Central Govt.
      – Create a grid in which you have to show how much is the basic salary and allowances. Make sure it is closer to the sate government norms.

      – You have get teachers who are trained and have requisite BEd. or NTT degrees.

      The class room area is specified in the bye laws for 45 students. Please have a look, if your intake is less than you can moderate the area proportionately.
      On the permission from the tail Nadu board, YES you have to acquire the affiliation before the school starts and for CBSE affiliation.

  46. the school has submitted certificate for land area 9810 sq.mtrs issued on 27.06.2013 indicate old society name . it is evident that even after change of society in dec 2012 the land school is required to submit revised land certificate indicating all parameters and name of school in the format given at appendix 6th of affiliation by-laws duly signed by the competent authority indicating compactness of land.
    2. the school is required to appoint 01 more trained teacher and wellness teacher to maintain section teacher ratio i.e.1:1.5 teachers per section to teach variois subjects. revised list of staff showing name ,qualification,designation,date of birth,date of appointement, date confirmation etc.is required to be submitted.
    3.The school is pay uniform and consolidated payment of rs. 11,100/- to all staff.hence the school is required to submit pay structure of corresponding cadre of state education department and ensure that salary,HRA,DA and other allowance are being paid as per state govt. norms/V1th pay commission duly singed by bank authorities indicating employees account no. and payment.
    4.the school is required to develop playground with requisite facilities & demarcation of various play courts and furnish evidence for the same in form of video converting the school building, playground ,play facilities and boundary wall around campus

    I am going to apply for CBSE affiliation. Meanwhile I have got some doubts while preparing the documents. Need your suggestions/advice on following points:
    1. Regarding Affidavit of Non-Proprietary Character of Society –
    If I get it correctly, this letter should be issued by secretary of the society (NOT SCHOOL MANAGEMENT COMMITTEE) stating that there is no body in my blood relation with in the society (not in SMC). Correct me if I am wrong here.
    2. Regarding the salary of teachers –
    Currently we are paying around 8k-15k to the teachers. But according to 5th / 6th pay commission, adding up all the components(Basic+Grade+DA+HRA) comes around say 30k. Now how should we deal with this situation?
    a) If we show the salary on paper according to the norms(30k), then how can we transfer the same salary to the teachers through the school bank account as their actual salary is just near 15k!!
    b) If we show the actual salary on paper, then their are high chances of getting objection from CBSE?

      1. Regarding Affidavit of Non-Proprietary Character of Society – The letter should be issued by the Chairman / Head Trustee / President of the Society / Trust. Even if there are few blood relations, one needs to specify. I have written a post specifically on this topic, please read up.

      2. Regarding the salary of teachers – Don’t show anything which is not legal. Show what you are paying, CBSE only asks schools to abide by the government rules and state rules. But it is difficult for private schools to do it. So create grades for teachers and do a good work with basic and allowances allocation. Pay all the salaries through cheque and into their bank account. If the number of employees is more than 19, go for Provident Fund number and registration.

    Our inspection was conducted on March 17,2015.Now we got a deficiency status
    The school has 3.32 acres of land in favour of society but certificate of land shows 02 acres of land in favour of school. Therefore, the school is required to submit copy of resolution with regard to allotment of 02 acres of land out of 3.32 acres to school duly signed by all members of society.
    2. 03 teachers are untrained whereas the school is required to appoint all the teachers (on permanent basis instead of adhoc) who are trained and qualified as per provisions of Affiliation Bye-Laws of the Board. The school is required to maintain section teacher ratio i.e. 1.5 teachers per section at each level. Hence, a copy of revised staff statement is required to be submitted showing Name, Qualification, Designation, Date of Appointment, Date of Confirmation etc.
    3. As per videography, it appears that science and computer labs are one only, therefore, the labs needs to be shifted to be in 02 different separate labs.
    4. The school is required to construct proper pucca boundary wall around the whole campus and submit completion certificate from the appropriate authority along-with documentary/videographic evidences.
    5. As per videography, it appears that a portion of the building is under construction, therefore, the school is required to complete the under construction work and submit completion certificate from the appropriate authority along-with documentary/videographic evidences.
    6. The school is required to submit certificates of fire safety, building safety and safe drinking water from concerned authority which are mandatory.
    7. The school is having 05 computers in computer lab and others are laptop which seems to be temporary arrangements. Therefore, the school is required to purchase more computers for labs and submit evidences accordingly.
    8. The school is required to develop playground properly as the same is full of debris remnants of construction and submit videographic/photographic evidences.
    9. Enrollment is low in some section. Therefore, the school is required to make more efforts to increase the enrollment.
    10. All the documents (each page) forwarded to the Board must be signed by the Manager and Principal of the school.

        The 2nd point what they have mentioned is that 3 untrained teachers are there.But according to the staff statement, we have no untrained teachers.for classes 1 to 8, one section each ,we have 13 teachers including principal and 2 D.Ed’s

        Regarding the computers in the lab
        Our school is an upcoming school and we got 22 laptops which were sponsored to our school.But in the letter, its mentioned it like a temporary setup which is not correct.
        Now, on these two matters,we need a clear idea on how to go about it.

          ON these two accounts, what I could suggest is you provide the purchase orders of the laptops or bills along with a video of the class or the photograph of the students using it. Also you can write in details about he configuration and installed softwares and internet facility if it is available.

          Though this objection regarding teacher qualification is very interesting as it is the school who is supposed to fill in all the info about qualification of teachers. I suggest which teachers are they referring, than possibly you can give them some explanation.

      Here is trying to answer your questions;
      1. Please tell me what is the class room size for a cbse school to accommodate a strength of 40 students.
      – A minimum size is mentioned in the Bye Laws for 45 students. You can take that as the standard. Though CBSE is not that damant about the size of the class, but it should be comfortable. I suggest you plan for a size of around 20 Feet X 25 Feet. Should be sufficient

      2. I was told that as per the latest Government Order, NOC from State Government is not necessary to apply for affiliation for cbse schools. Is that true? – YES, I have written a separate post on the same. Do read.

      3. Is affiliation from State government is different from NOC from state? –
      – YES, affiliation is when the state board allows you to run a school and NOC is when they say they have no objection if you apply for CBSE Affiliation.

Simultaneously try getting in touch with a bank and put up a request for term loan.         The entire land (more than 2 Acres) required for CBSE affiliation should be at one place and the school building (all classrooms etc) should be constructed on the same piece of land.

      Earlier also I enquired about one matter regarding C.B.S.E. affiliation and I got very much useful response from your end. Now again I have a problem.

        For others: it is extremely essential to make requisite preparations and build infrastructure accordingly, otherwise due to deficiency and non-compliance affiliation can go into one loop putting schools in a spot of bother.

        Yes DEO and state board affiliation are same. DEO and his team are supposed to evaluate and approve of affiliation for schools in their district. As I have written in my post it is mandatory for schools to procure State affiliation before applying for CBSE affiliation.

      1. Dear Vineet, Till now it is the schools who have been able to decide their fee structure as per their discretion. But can’t say for certain either it is going to stay this way or the same rule will apply across states. This issue keeps arising over years esp with parents group knocking on judiciary or the local education office doors. There are assosiations on both sides pleading their interests, but as of now schools are deciding on their own.

      1. Dear Humaira, There is no such requirement by the CBSE stating minimum sessions. Just to quote an example if the school is supposed to start their operation in July 2016, than the school can apply for CBSE affiliation by June 2016. So in this the application for affiliation is made even before the school has started operation. But to manage all of this the requisite state level permission should be there with the school. So in most of the cases school finish a session and then apply for CBSE. Hope this clears your doubt.

      1. It should be a single piece of land, all at the same place. The Land Certificate is a very important document required for CBSE affiliation where the school has to certify that “the said entire land comprises of a single plot of land”.

        Answers to your questions.
        1) Does any permission from state government is required to open a school in rural areas up to seven classes and where should apply for this – Yes it is MANDATORY to take state governments permission. You have to approach the local District Education Office (DEO).

        2) our land is agricultural. Does it required for convergence into residential? And from where? – YES you to get the LAND USE DIVERTED, the right place for that would be the Land Registrar Office. You will ahve to check the land use for your area plus you will have to pay the appropriate diversion fee.

        3) After runing the business 2 years in franchise mode , whether we can go for own brand for cbse affiliations. – Yes you can. Though I will not suggest this route. Firstly you will invest resources in building the brand in your case franchise and later on you will leave it. Make up your mind form the beginning on the path you want to adopt.

        4) Whether Construction of building is required for any approval?? – Yes from the TOWN & COUNTRY Planning department. Get in touch with a local builder he shall give you the details relating to land and building permission.

          In the letter “Defiiency after IC”, followings are mentioned:

          1. Playground needs development with respect to sports events.
          2. The school is required to disburse the salaries of staff through ECS mode instead of cash/Cheque. A certificate from the Banker may also be submitted for the purpose.
          3. The School is required to extend EPF facility to all the staff and to submit copy of challan through which amount of EPF has been deposited in the concerned
          Department.
          4. The school is required to pay prescribed pay scales along with DA and other admissible allowances to the staff at least at par with the State Govt. pay scales or
          6th pay Commission through ECS alongwith the proof of pay scales in concerned state Govt.

          Please guide.
          About point – 4: we are following 6th pay commission for pay scale but having a DA of 51%. Is it a reason? What should be done.
          About Point -2: would passing a resolution from the SMC and getting a certificate for the purpose from bank be enough or need we to show the ECS transfer. I am asking this because they have given only 20 days of time for reply.
          About point – 1: would passing a resolution from the SMC be enough for the time being because development of ground would not be possible in 20 days.

            – I dont know how much are you paying, assuming your salary are healthy enough, I suggest you make requisite allotments within the same amount of money.

            – Pass a resolution from the society / trust. Whenever you have to disburse salary send a letter to the bank with bank account numbers of all the employees and the money which need to go into each one of their account. Show this letter as proof to CBSE.

            About point – 1: would passing a resolution from the SMC be enough for the time being because development of ground would not be possible in 20 days. – This is a typical query, If I would have been you, I would try to send them a resolution from the society and the SMC along with a few work orders and quotations for sports equipment etc.

        The answer is YES you can do it i.e you can go ahead and apply. As far as applying in class VIII is concerned, I have written it telling readers about that that is the least to which you can stretch your application.

        You can understand the difference between Provisional & Permanent affiliation by the analogy of Temporary and Permanent employee at an organization. Firing a temporary comes with less riders and dismissing a Permanent comes with heavy repercussions. Public sector schools can directly go for Permanent affiliation, whereas a privately aided school has to go for Provisional affiliation first and after the lapse of three years for Permanent affiliation. Quoting form the bye laws ” the Board may grant extension of provisional affiliation granted for a further period of 3 years to 5 years subject to fulfill the conditions of affiliation in the extended period.” This is in case any school is still to fulfill any pre condition which is lacking as per the CBSE norms. There are certain other norms which you can read from the bye laws.

        What were the deficiency pointed out while you had your inspection, depending upon that nature of deficiency things will proceed from here. In case if they are remedial in nature same will be communicated to the school, in case if they are of permanent nature, things could be otherwise. I suggest you hold on and wait for the official letter from the CBSE explaining the deficiency.

When I went for its registration in out state capital, it was stated that ‘Trust registration’ is a district subject but the problem is that we do not have any Registrar office in our district. So, I have notarised our Trust and got a ‘Notarial Certificate’. Please let me know, more on it so that my application is not turned down.

      1. Taking permission form the DEO is alright, that is what getting affiliation from the State Board is about. For the trust office this is a local issue, kindly speak to some advocate who could advise you in that regard.

        In Tier-I Cities Pre Primary – Class XII (Mumbai/Delhi/Chennai/Kolkata/Banalore/Hyderabad) + Ghaziabad Noida Faridabad and Gurgaon (NCR) Panchkula + Arunachal Pradesh the requirement is 1 Acre.

        So, in 1 Acre in NCR you can start the school upto Class XII, no issues.

        I believe you are good for CBSE affiliation though there must be minor deficiencies which they must have detected which can be taken care of by you in due time. Most of the times, they are in the form of books in the library or inadequate size of some given facility or number of teachers etc. But the affiliation will come through and you would be required to do away with these issues in due course of time and reply back to CBSE that you have taken care of the same.

      As, prior to amended rule any school can apply for provisional affiliation of a secondary school if they obtained NOC.

      Then what is the worth of NOC exemption if school has to be recogised by state board/Department.

      Otherwise please interpret the amended rule 3.3(1) chapter II especially, the following;

      1. Dear Mr. Ali, In case things are fair from your end and you have completed all the formalities and the infrastructure required by CBSE, you do not have to worry. In case the inspection team still writes a negative report, you can always challaenge it. The process is explained in the bye laws, kindly read.

      1. CBSE says it should be a single piece of land, quoting from the bye laws. There is a document called APPENDIX VI, where the management has to produce an affidavit where they have to sign on the following – “It is certified that the said entire land comprises of a single plot of land.”

      We are a school in Karnataka currently running up to class 8 and are affiliated with state board and had made an application to CBSE for provisional affiliation/ switchover up to secondary level in Jun 2014. In the last week of Jan 2015 we have received a deficiency letter from CBSE that states that we have to submit NOC/ Recognition letter from State/ UT Government at least up to Class VIII.

      The process of getting permission or affiliation from state government in Karnataka and the first step to start a school here is called ‘Registration’ and that needs to be obtained from Dept of Public Instruction, Government of Karnataka. We have got ourselves Registered and are currently running the school up to 8th class. Getting Recognition here is similar to getting Accreditation from CBSE which is a next process. We currently have Recognition only up to class VII only. Under such circumstances what can be done.

        Query: We have received a deficiency letter from CBSE that states that we have to submit NOC/ Recognition letter from State/ UT Government at least up to Class VIII.
        Possible resolution: ZIf you are running the school under Karnataka State Education Board, you have to produce an affiliation letter from the Karnataka State Education Board.         – The right to approach/apply to CBSE for affiliation for class IX is by the June of the academic year when Class VIII has starts in your school. By June you apply, inspection happens by the end of the year and affiliation comes by Jan – Feb so that you can start your Class IX at the right time.

        You don’t have to worry too much if the objectives of the society lists out education as its focus area. It is not necessary in the society’s Bye-Law the name of institute is to be mentioned. Even after this you feel like you would like the name to be mentioned somewhere in the bye-laws,
        Do the following;
        1. Convene a meeting of the members of the society.
        2. Record the minutes of the meeting where a resolution to amend the bye-laws gets passed.
        3. Make an application to the Registrar of Societies informing him about the change and submit the application to his office.
        4. Get a new set of APPROVED Bye-Laws.

        1. Can I start classes upto 8 without affiliation to state/CBSE – No you cannot start a school without the state’s permission. In fact CBSE will only affiliate you once you state’s permission. You have to create a trust or society to start the school.
        2. How to proceed for affiliation with CBSE without state nod/recognization! – Restating my response to the first question, you cannot proceed for CBSE affiliation without the stat’s permission.

    55. We had applied for CBSE Affiliation inspection had also done and 25 days back when we check online application status then it says rejected and on the letter tab it shows “Letter Coming Soon” what should we do now can we wait for more days or anything else …

    56. Our school has received the deficiency letter from CBSE in mid December 2014.Surprisingly NOC was one of the deficiency points though CBSE says NOC is not mandatory. There were 3 other minor points. We have filed our compliance for these points also. The compliance letter with supporting documentary and photographic evidence has been sent to CBSE Delhi, 10 days ago. What will be the next step? When can we expect CBSE to respond now?. Thank you.

        The comment in the letter sent by the CBSE must be stating this – “The school has not submitted NOC/Recognition letter atleast upto class VIII issued by state education department”. It can not state only NOC. According to this they mean to ask you to send them the letter of recognition/affiliation of the state board.

        The course of action will be to send them the document which they require now.

        1. The comment is “The school has submitted the copy of NOC which is not signed. Hence, the school is required to submit signed copy of NOC from Competent Authority.”
          Actually, we only sent our permission letter obtained from the state board and also evidence to show that we have informed the state board about our intention to affiliate with the CBSE. For some odd reason CBSE has mentioned about NOC! Anyway, we have now resend all relevant documents.

        – Will depend upon the kind of deficiency, more often than not schools are given a chance to clear the issue and inspection happens as scheduled.

        – Pre Inspection – Stage 1 (under scruitny ) , Stage 2 (Inspection committee constituted)
        – Post Inspection – Stage 1( Inspection has been conducted, report is Under consideration), Stage 2 (Approved / Rejected)

        1- when we start up a school what is the first affiliation we apply for ? (i mean upto what class) – Depending upon your respective state board rules and based on your plans you can go for various grades. For Example up to Middle Class, Secondary or Higher Secondary. As far as CBSE goes, you have to first apply for either Middle Class or Secondary Classes and subsequently apply for Higher Secondary.

        2- how long after starting the school shall we apply for the affiliation ?
        For CBSE you can apply as soon as you start the school. The schools generally commence their operations from Mar/April, so by the June of the same year (the last date for application is June 30) you can apply for CBSE. The inspection team shall visit you between Nov/Dec/Jan and in case your institute is sorted the affiliation should come by Feb/March.

        3-is it legal to run a school even for the minimum of time without any affiliation ?
        Ideally speaking you cannot start a school without the prior permission from the state board. In fact there has been a ruling by the court to this effect exerting the power of the state, check this news in TOI

        4- till what class in a playway school we can teach without any affiliation ?
        I have no idea on this, but check with your state board. I think (this is my guess), education boards are increasingly looking to bring the early childhood education under their purview due to RTE.

        Answer: Provisional affiliation means a temporary period granted by CBSE before they finally affiliate a school permanently. Now there are two stages of rejection 1)Post Application Stage 2) Post inspection Stage.
        At application stage most often reason for rejection could be land requirement document. In case some deficiency found during inspection unless or until it is irreparable schools get affiliation and a letter of caution by the CBSE.
        What are the deficiencies that CBSE normally condones for provisional affiliation? How long do we get to set these deficiencies right? There seems to be an inordinate delay from CBSE this time. We still have not even received the deficiency letter. Do you have any information about this?

        Who will give this Approval for CBSE at district lavel? – You don’t have to procure permission for ‘CBSE’ at the district level. You have to take affiliation from the State Board for which the District Education Office is responsible.

        Can I start the admission only after getting approval from local education office? – Ideally YES, that is how it follows. Since you have to have permission from the local government to start a School in India and CBSe will consider your case only when you have an already existing school.

        Sir will you provide the all 36 mentioned document’s Model/sample with 5000/Rs. – yes I will send you the templates.

        I belongs to a rural area, in such places who is the authority to pass the architectural map? – Check with Town and Country Planning department. If they tell you that your area is beyond their jurisdiction, try getting the information from the District Education Office. In case they sound clueless, talk to the village governing body – The Panchayat / Sarpanch.

        “Class rooms should be adequate in size.- The minimum floor space should at least be 1 sq. metre per student.” {Page 14. Section 8.1}

      1. You will certainly receive a detailed reply where they found your infrastructure or facilities lacking. My guess is the deficiency might be in the Land Certificate or the composition of your trust/society. It will take about 2-3 weeks

        1) formation of a trust/society to run and manage the school
        2) affiliation from any of the boards state/national/International.
        So the answer to your question is yes you have to take affiliation from the state board.

If it is non-profit organization, why do people say it is a profitable business these days? Please suggest.

      1. This is from the CBSE bye-laws;
        1. In case of schools belonging to category 3(1 ) (v) there should be a properly constituted Registered Society/Trust. It should be of a non-proprietary character and its constitution be such that it does not vest control in a single individual or members of a family. The aims of the society/trust should be as laid down under section 19(1) and (2).
        2. Formation of the Society/Trust should also conform to the State Government rules in which the school is located.
        3. The Board may in special circumstances exempt schools from operation of the above clause in respect of schools set up in foreign countries where societies/ trust in the name of Indians cannot be registered under any law or enactment.

        Check from the State Govt. whether OCI can be a part of the society. I didn’t get the second part (Is there any maximum limit on the numbers of trust?).
        It is supposed to be run by Non-Profit organization, but how and where will that society secure money to fund its operation. There will be a time when the society has to pay it back with interest, plus the caretakers will earn their salary and perks as part of their involvement regarding management of the school.

      We(group of 3 people) have started a school in 2012 and right now it’s functioning from Play group till class 8th having permission from local DEO. Since now our goal is to expand it to further classes (i.e. 9th and 10th), CBSE affiliation is needed.

      Since the last date of its application has passed i.e. 30th June this year, we will have to apply next year only I suppose:
      => If we apply for CBSE secondary level affiliation in 2015, then can we start both classes 9th and 10th or only class 9th in the academic session 2016-17 which is the session immediate after getting secondary level affiliation?
      => We know it’s already too late for us to apply for secondary level affiliation; nevertheless we will anyway have to apply for the same next year. But our worry is about students studying in class 8th this session. Because anyway we will not get affiliation for next session. Is there any workaround possible to fight with this issue? Otherwise we will have to issue T.C. to all the students of class 8th at the end of this academic year. 🙁

      In the process of getting affiliation from CBSE, I read in CBSE bye-laws that it requires atleast 2 acres (considering our location):
      => We have seen quite a lot schools in the same town which are not having ample amount of land prescribed by CBSE. Therefore curious to know if there is some workaround possible for the same. I am asking this question as our school land is a bit less than 2 acres (around 1.6 acres). Will that work?
      => Moreover CBSE asks for land to be converted from agriculture to commercial (education purpose). My question is they asks for whole (2 acre) land to be converted or the area on which school building has been build and not the one having playground?

      We will be highly delighted to get these questions answered as we are unable to find any expert in this field to whom we can discuss.

        Answers to your queries.
        Query 1) If we apply for CBSE secondary level affiliation in 2015, then can we start both classes 9th and 10th or only class 9th in the academic session 2016-17 which is the session immediate after getting secondary level affiliation?
        – For a school introducing Class IX, the affiliation would have to be sought before one starts Class IX. You are only allowed to start Class IX.

        Query 2) The dates for application went through some extension, but really can’t be helped now. The maximum you could do is ask students to continue with the state boards or else have to let them go.

        Query 3) Land less than 2 Acres – As far as I know, there is no way around this. Some of the schools either they must be old when the laws were not stringent or they must have shown some land to the authorities which as an outsider is not known to you.

        Query 4) Agriculture to commercial (education purpose). My question is they asks for whole (2 acre) land to be converted or the area on which school building has been build and not the one having playground? – Diversion of land should happen for the entire 2 Acres.

      Our school is running under trust which comprising 6 members out of which 3 are blood related. is it a problem?
      We have purchased the land for school in two phases. first one is in the name of Smt. B.L.Sen who is the settler of the Trust and while registering the trust she has authorized the trust to use this land for the school purpose. Rest portion of land is registered in the name of the trust itself. will it be any problem?
      We have applied for fire safety certificate which is yet to be received. Will it be a problem?
      Some of our teachers are untrained as shown in the online application. Will it be a problem.

        1) I don’t know which city are you guys located but I have written enough about the land requirement in my post, please go through it.
        2) School has to be situated on a single piece of land, kindly refer to the Appendix VI i.e CERTIFICATE OF LAND and read the last line of the first paragraph. It clearly states that the District Magistrate or The Registering Authority has to certify that “It is certified that the said entire land comprises of a single plot of land”.
        3) Room sizes can vary depending upon number of students you are looking to admit. Though a notional measurement given by CBSE is in the Bye Laws (Read Page 7), “Class rooms – minimum size should be 8 m x 6 m (approx 500. sq. ft.)”.

          1. I think the relaxation is for the schools affiliated before 1996. The relaxation comes in the form of Land Requirement. To quote from the bye laws “The schools which were granted affiliation upto Secondary level on or before the year 1996 under the (relaxed condition of land requirement under category “B” or
            “C” may be considered for Upgradation to +2 stage provided. that they should have atleast one acre of land”.
            Please check with the CBSE Delhi office before proceeding further on this account.

        3. Sir, there is some confusion regarding the room size. In one of the letter that you shared (regarding your school’s affiliation to SSC) the room sizes mentioned are :
          Classrooms – 22X18 (396 sqft). Which one should be followed ? Is it sacrosanct for getting the affiliation ?

      1. I have received this query earlier also. In this case, please check with your DEO office this same question. Is the letter given to you by the DEO office a substitute for an affiliation letter? CBSE is asking for the affiliation letter as they want to make sure it is a genuine school with basic minimum infrastructure already vetted by the state affiliation board.

        You can only go for approval up to Secondary Level once you have Class VIII. Since you have classes up to Class VI, I suggest you have to take an approval up to Middle School. I suggest introduce Class VII & VIII and apply for approval up till Class X. This will save you time, effort and money.

        Answer: Yes, that is alright. Land should be either owned by the Trust/Society or should be Leased to the society for a period of 30 years or more.

        Q2) School running through trust. Now is must for Non-Proprietary Affidavit for trust. ———->
        Answer: The trust/society running the school should strictly have Non-Proprietary character.

    102. i would like to know the permissible strength of students from nur – 7th class as we need to fill the information in the CBSE affiliation form.Also let us know the number of teachers from nur – 7th as the total strength is 392.

      1. There is should be no more than 45 students in a class. There is no minimum limit. Total number of teachers should be Total number of section multiplied by 1.5. Example if you have 10 section from nursery to Class VII, total number of teachers should be 10 X 1.5 = 15 + Principal. You gotta have a qualified Librarian. No way out, it could be critical.

      CBSE has waived off the requirement o .n o c and gave an option of recognition letter from the state govt.so let us know can we use that recognition letter as l mentioned above as we are going to e- apply for CBSE affiliation for secondary level and we need to know about the recognition letter as early as possible..

        I don’t know about this RTE letter you are mentioning. I am assuming if you are already running a school and teaching kids under RTE and getting paid for it by the government, you must have taken an affiliation from the State Government. That is the certificate with the highlighting the School’s affiliation number is what CBSE is asking you to upload.
